Agreement to Terms
By accessing or using the Happi Hour mobile application, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this app. The materials contained in this app are protected by applicable copyright and trademark law.
Use License
Permission is granted to temporarily download one copy of the materials on Happi Hour's mobile application for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials
- Use the materials for any commercial purpose or for any public display
- Attempt to reverse engineer any software contained on Happi Hour's server
- Remove any copyright or other proprietary notations from the materials
- Transfer the materials to another person or "mirror" the materials on any other server
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Happi Hour at any time.
User Accounts
When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.
You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Content and Conduct
Our app allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material. You are responsible for the content that you post to the app, including its legality, reliability, and appropriateness.
By posting content to the app, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the app. You retain any and all of your rights to any content you submit, post, or display on or through the app and you are responsible for protecting those rights.
Accuracy of Information
While we strive to provide accurate and up-to-date happy hour information, we cannot guarantee that all information on our app is correct, complete, or current. Information regarding happy hour deals, prices, and times is provided as reported or collected, but may change without notice. We advise users to confirm details with the venues directly before making plans.
Prohibited Uses
In addition to other terms as set forth in the Agreement, you are prohibited from using the app or its content:
- For any unlawful purpose
- To solicit others to perform or participate in any unlawful acts
- To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information
- To upload or transmit viruses or any other type of malicious code
Disclaimer
The materials on Happi Hour's mobile application are provided on an 'as is' basis. Happi Hour makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Happi Hour does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this app.
Limitations
In no event shall Happi Hour or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Happi Hour's mobile application, even if Happi Hour or a Happi Hour authorized representative has been notified orally or in writing of the possibility of such damage.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of California and you irrevocably submit to the exclusive jurisdiction of the courts in that State.
Changes to Terms
Happi Hour reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our app after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the app.
